20-11-2017 Heard Sri Ajay Kumar Thakur, learned counsel assisted by Sri Pravin Kumar, learned counsel for the petitioner and learned Addl. Public Prosecutor.

The sole petitioner, having clean antecedent as stated in paragraph - 3 of the petition and in custody since 29-04-2017, has prayed for grant of bail in Karaipursurai P.S. Case No. 44 of 2017 registered for offence under Sections 25(1-b)(1-c)a/26/35 of the Arms Act, 1959.

It was submitted by learned counsel for the petitioner that it is true that from a Maruti car, of which petitioner is owner, country-made rifle, cartridges and other articles were recovered, but fact remains that the said vehicle was occupied by five passengers. Petitioner was simply carrying the passengers and without his knowledge, arm concealed in a bag

Patna High Court Cr.Misc. No.55343 of 2017(2) dt.20-11-2017 2/2 was kept in the car and only after interception, the petitioner noticed that in his vehicle, there were arms and ammunition. Considering the nature of accusation, clean antecedent as well as period of custody, let the petitioner namely Rajeev Ranjan Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Addl. District & Sessions Judge - III, Hilsa at Nalanda in connection with Sessions Trial No. 483 of 2017 (arising out of Karaipursurai P.S. Case No. 44 of 2017).
