The petitioner seeks bail in a case instituted under Sections 269, 270, 272, 273, 201/34 of the Indian Penal Code and Section 47(A) of Bihar Excise Act.
It is alleged that total 35 litres of country made liquor is said to have been recovered.
It has been submitted on behalf of the petitioner that the petitioner is in custody since 29.07.2017. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. It is a case of misuse of privilege of bail. The petitioner is a daily wage worker. He has gone out of the State for his livelihood. There is no compliance of section 100 of the Cr.P.C. Learned counsel for the petitioner further submits that he will co-operate and present in the court
Patna High Court Cr.Misc. No.50289 of 2017 (2) dt.17-10-2017 2/2 below on the date fixed by the trial court.
On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-II, Siwan, in connection with Mairwa P.S. Case No. 72 of 1999 (Tr. No.1630 of 2017).
The petitioner shall remain present in the court below on the date fixed by the trial court failing which the court below will be at liberty to cancel the bail bond of the petitioner. (Sudhir Singh, J) Amit/- U T
