JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Section 406 of the Indian Penal Code.
It is alleged that on 05.05.2015 the petitioner took Rs. 1,15,000/- from the informant on assurance to return on 05.07.2015 but it was not returned. On demand being made the petitioner threatened to implicate the informant in false case.
It is submitted by learned counsel for the petitioner that petitioner lodged Beur P.S. Case No. 143 of 2015 on 22.07.2015 levelling accusation under Sections 147, 323, 341, 379 of the Indian Penal Code and thereafter the present case has been lodged on 23.07.2015. Moreover there is no proof with regard to taking money by the petitioner from the informant. Though the petitioner is accused in one other case
Patna High Court Cr.Misc. No.58055 of 2015 (2) dt.04-01-2016 2/2 under Section 302 I.P.C but he is on bail in that case. A statement to that effect has been made in para 3 of the petition. Considering the nature of accusation, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna in connection with Beur P.S. Case No. 145 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
