JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 448, 324, 34 of the Indian Penal Code.
The prosecution case is that when the informant made protest for cutting the soil of her land then petitioner No. 1 assaulted with spade causing injury on the hand and palm. It is specifically alleged that petitioner Nos. 2 and 3 also assaulted the informant on waist and lower portion of the abdomen by lathi and when daughter of the informant came to rescue then she was also assaulted.
It is submitted by learned counsel for the petitioners that though one injury on the palm has been found to be grievous, but other injury has been found to be simple and in the background of land dispute the accusation has been
Patna High Court Cr.Misc. No.1526 of 2016 (2) dt.12-01-2016 2/2 levelled. Moreover the petitioners are agnates of the informant. Considering the genesis of the occurrence and the petitioners being agnates of the informant, let learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Barahat P.S. Case No. 60 of 2015, pending in the Court of learned Chief Judicial Magistrate, Jamui.
With the observations above, the application stands disposed of.
