The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections341, 323, 354, 354(B), 506 and 504/34 of the Indian Penal Code. The prosecution case is that on 25.09.2015 at about 8.00 A.M. the mother of the informant was cutting grass behind cattle shade when the petitioner came, caught her hand and started dragging her when she made protest then petitioner tore her blause and assaulted her with danda and when the mother of the informant caught the petitioner then the petitioner
Patna High Court Cr.Misc. No.57261 of 2015 (2) dt.18-12-2015 2/3 fell her on the ground and started assaulting her with fist and kick then co-accused Birendra Ram came and caused injury to the mother of the informant with danda.
It is submitted by learned counsel for the petitioner that for a petty dispute with regard to tying of the cattle in the land of the petitioner the accusation has been levelled. The case lodged by the petitioner is at earlier point of time being Uchkagaon P.S. Case No. 176 of 2015 registered on 25.09.2015 at 11.30 A.M. when the present FIR was registered on 26.09.2015 at 10.00 A.M. for the occurrence of 25.09.2015 at 8.00 A.M. and even assuming the accusation the accusation under Section 354(B) is not made out and there is no medical examination of the mother of the informant.
A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the case lodged by the petitioner at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-divisional Judicial
