2. At the outset, Mr. Hari Kishore Thakur, learned counsel for the appellant, submits that during pendency of this case, sole appellant, namely Ganga Bhagat, has died. In support of the same, he has produced death certificate of the appellant which is being kept on record and as such, this appeal has become infructuous.
3. In view of the aforesaid facts and circumstances of the case and also Section 394 of the Code of Criminal Procedure which corresponds to Section 435 of the Bharatiya Nagarik Suraksha Sanhita, since no near relative has filed any application for leave to continue the appeal, this criminal appeal stands abated and disposed of.
4. Accordingly, let the trial court records be sent back
Patna High Court CR. APP (SJ) No.4235 of 2018(4) dt.22-07-2026 2/2 to the concerned court immediately, if not required in any other case.
