The petitioner apprehends his arrest in Rohtas P.S. Case No. 145/2015, registered for the offences punishable under Sections 147, 148, 149, 323, 379, 427, 337, 338, 435, 436, 504, 307 and 353 of the Indian Penal Code and Section 3(2) E of the Prevention of Damage to Public Property Act.
A motor accident took place in which two persons were killed on the spot and some animals also got injuries. The informant rushed to the place of occurrence but the crowd damaged the vehicles and also assaulted the driver and travellers of the vehicles.
It is submitted that the petitioner is, of course, named in the FIR but no specific allegation is made against the petitioner.
Patna High Court Cr.Misc. No.46909 of 2016 (2) dt.13-12-2016 2/2 Similarly situated co-accused persons, namely Harendra Kumar and eight others have already been granted anticipatory bail vide order passed in Cr. Misc. No. 30889/2016.
Considering the facts aforesaid and the fact that the case of the petitioner stands on the similar footing as that of Harendra Kumar and others, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Dehri (Rohtas) in connection with Rohtas P.S. Case No. 145/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
