In this application for anticipatory bail, the petitioner apprehends his arrest for the offence punishable under Sections 341, 323, 307, 504/34 of the Indian Penal Code. Allegedly, Rajendra Yadav, petitioner, Niranjan Yadav and Kismatia Devi started abusing the informant and assaulted him with fists and slaps whereas Indradeo Yadav assaulted him with lathi causing head injury. Submission is of false implication and that against the petitioner there is no specific allegation, specific allegation is against Indradeo Yadav who has been allowed pre-arrest bail vide Cr. Misc. no. 52480 of 2016 dated 07.12.2016
Patna High Court Cr.Misc. No.51488 of 2016 (2) dt.19-12-2016 2/2 by a co-ordinate Bench of this Court and as such petitioner also deserves sympathetic consideration.
The learned A.P.P. opposes the prayer for bail. In the facts and circumstances stated above, petitioner Santan Yadav, in case of his arrest or surrender before the Court below within four weeks from the date of receipt/ production of a copy of this order, shall be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Kutumba P.S. case no. 96 of 2016 subject to the conditions as laid down in Section 438(2) of the Code of Criminal Procedure.
