JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The petitioner prays for anticipatory bail in connection with Sultanganj P.S. case no. 212 of 2003 registered for the offences punishable under Sections 467, 468, 471, 420 of the Indian Penal Code.

The allegation against the petitioner is that he obtained the job on the basis of forged certificate It has been submitted on behalf of petitioner that on the basis of the present F.I.R. similar allegation has been attributed against to persons including the petitioner and one accused Anil Kumar has already been granted bail by this Hon'ble Court vide order dated 04.10.2013 passed in Cr. Misc. no. 25670 of 2012.

Having heard both sides in view of the fact that other co-accused has already been granted bail by a co-ordinate Bench of this Court, let the abovenamed petitioner, in the event of his arrest or surrender before the Court below within a period of six weeks, be released on anticipatory bail on furnishing bail bond of Rs. 50,000/-(Rs. Fifty thousand) with two sureties of the like amount each to the satisfaction of Adddl. Chief Judicial Magistrate, Patna City in connection with Sultanganj case no. 212 of 2003 subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
