====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 23-11-2017 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case registered for offence punishable under Sections 272, 273 of the Indian Penal Code and Sections 30 (a) and 41 of Bihar Excise Amendment Act, 2016.

It is contended that, as per allegation, about 38 liters of foreign liquor was recovered from the bush and the petitioners were apprehended by the police after chase. Nothing has been recovered from the physical possession of the petitioners. It is urged that the petitioners have remained in custody since 26.09.2017,i.e., about two months. It is claimed that their antecedents are clean.

Considering the facts and circumstances of the case, the

Patna High Court Cr.Misc. No.56059 of 2017(2) dt.23-11-2017 2/2 petitioners, above-named, are directed to be released on bail on furnishing bail bonds of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of 3rd Additional District Judge-cum-Special Judge, Excise Act, Muzaffarpur in connection with Sakra P.S. Case No. 359/2017 with a condition that if the petitioners, after their release in this case, are again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of their bail bonds.
