The petitioner is in custody in connection with Sessions Trial No. 105 of 2017 arising out of Parbatta P.S. Case No. 94 of 2016, a case under Sections 302, 201, 120(B)/34 of the Indian Penal Code.
It appears that co-accused Rekha Devi was allowed bail, having similar allegation, by a co-ordinate Bench of this Court in Cri. Misc. No. 5931 of 2017, considering the fact, that she was a female.
By the same order, annexed as Annexure-I, prayer of bail of this petitioner was refused and liberty was given to him to renew the prayer for bail, if the trial is not concluded within eight
Patna High Court Cr.Misc. No.59517 of 2017 (2) dt.26-02-2018 2/2 months. The impugned order does not show that the trial progressed and petitioner is in custody since 23.06.2017. Hence, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Sessions Trial No. 105 of 2017 arising out of Parbatta Police Station Case No. 94 of 2016 with condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
