The petitioner apprehends his arrest in connection with Complaint Case No.1227C of 2017 registered under Sections 406, 379, 498A, 323, 313, 504 and 506/34 of the Indian Penal Code besides Section 4 of the Dowry Prohibition Act, pending in the court of the Sub Divisional Judicial Magistrate, Saharsa.
Learned counsel for the petitioner submits that in the court below, the dispute in between the petitioner and the opposite party no.2, who are husband wife, has been settled
Patna High Court CR. MISC. No.69511 of 2018(9) dt.01-07-2019 2/2 through mediation and, accordingly, the petitioner and the opposite party no.2 has filed Divorce Suit on mutual consent in which the date has already been fixed as 28.08.2019 and on the date of disposal of the Divorce Suit, the petitioner will pay Rs.2,20,000/- to the opposite party no.2.
Learned counsel appearing on behalf of the opposite party no.2 has not disputed the aforesaid submissions as advanced by the learned counsel for the petitioner. Since the dispute in between the petitioner and the opposite party no.2 has already been settled and, accordingly, the petitioner and the opposite party no.2 has filed Divorce Suit on mutual consent, the provisional anticipatory bail granted to the petitioner vide order dated 17.12.2018 passed by a Bench of this Court is, hereby, confirmed.
