JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 504, 506, 354, 307, 509, 34 of the Indian Penal Code. It is alleged that petitioner, after catching hold the hand of the informant took her to the field and when she started crying the family members came to rescue when the petitioner and others made assault.

It is submitted by learned counsel for the petitioner that even assuming the accusation no case under Section 307 I.P.C is made out against the petitioner. Moreover co-accused have been granted anticipatory bail vide Cr. Misc. No. 48449 of 2015.

A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. The aforesaid facts constitute ground for

Patna High Court Cr.Misc. No.406 of 2016 (2) dt.07-01-2016 2/2 consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Makhdumpur P.S. Case No. 217 of 2015, pending in the Court of learned Additional Chief Judicial Magistrate, Jehanabad. With the observations above, the application stands disposed off.
