The petitioner apprehends his arrest in UdaKishunganj P.S. Case No. 56 of 2014 instituted for the offence under Sections 302 and 201 of the Indian Penal Code and Section 27 of Arms Act.
It has been submitted by the petitioner that he is not named in the written report. The informant got information that dead body of her husband is lying beside Naya Nagar Canal and someone has killed him. It has further been submitted that in the entire case diary, no material has been found against this petitioner. The learned Sessions Judge has committed error of record in stating about different paragraphs wherein the allegation
Patna High Court Cr.Misc. No.45266 of 2016 (3) dt.04-02-2017 2/2 against this petitioner has been supported by the witnesses. Learned A.P.P has gone through those paragraphs of the case diary as mentioned by the learned Sessions Judge and found there is no any allegation against this petitioner. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Uda- Kishunganj P.S. Case No. 56 of 2014, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Uda Kishunganj, Madhepura, subject to the conditions as laid down under Section 438(2) Cr.P.C.
