====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 17-11-2021 Heard learned counsel for the petitioner and learned Public Prosecutor for the State.

Learned counsel for the petitioner is expected to honour her undertaking to remove the defects, as pointed out by the office, when called upon to do so by the office. The petitioner is apprehending her arrest in connection with Pandarak P.S. Case No. 22 of 2020 for the offence registered under Sections 304B and 201/34 of the Indian Penal Code.

Allegation against the petitioner is that petitioner along with other family members had killed the daughter of the informant by administering her poison due to non fulfillment of demand of dowry.

Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.39923 of 2020(4) dt.17-11-2021 2/2 petitioner being a mother-in-law of the deceased has falsely been implicated in connection with the present case on mere suspicion. It is further submitted that co-accused, namely, Ram Nandan Prasad @ Ram Nandan Gope, who is husband of the petitioner, has been granted regular bail by a co-ordinate Bench of this Court vide order dated 18.08.2021 passed in Cr. Misc. No. 15127 of 2021. It is further submitted that there is no specific allegation levelled against the petitioner. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner, above named, in the event of her arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. -I, Barh, Patna in connection with Pandarak P.S. Case No. 22 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr. P.C (Sunil Kumar Panwar, J) Jagdish/- U T
