The petitioners apprehend their arrest in connection with Gwalpara P.S. Case No. 59 of 2016 registered under Sections 409, 420 and 120B of the Indian Penal Code.

The allegation is of misappropriation of paddy crop amounting to Rs. 21,02,366/- in collusion with others. Learned counsel appearing on behalf of the petitioners submits that it appears from the supplementary affidavit that the Branch Manager, Begusarai has issued No Dues Certificate, informing that the petitioners have been free from the defaulter list, as contained in Anneuxre-4 to the supplementary affidavit.

No.45215 of 2016 (3) dt.17-02-2017 2/2 Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Udakishunganj, District- Madhepura in connection with Gwalpara P.S. Case No. 59 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
