Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

According to FIR, Rupesh Thakur the son of the informant was murdered by his wife with the help of her paramour. The petitioner is not named in the FIR whereas others are named therein.

Submission is that the petitioner is no where related to the family of the informant or his wife and co-accused, namely, Angoormala Devi has already been allowed bail by a Coordinate Bench of this Court vide order dated 29.08.2017 passed in Cr. Misc. No. 32084 of 2017.

No.61479 of 2017 (2) dt.19-12-2017 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Paharpur Police Station Case No. 77 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
