The present writ petition has been filed seeking the following relief:- "1.(i) For issuance of any appropriate writ or writs, rule or direction, especially in the nature of mandamus, directing the particularly Respondent No. 2, the District Magistrate, Madhubani to remove the private respondents from the land i.e. to Khata No.

1977, Khesra No. 5264, Arazi 52 decimal, Kism Bhumi-Rasta, name of Raiyat Anawad Sarvasadharan, which have forcibly encroached by the private respondents of the public way."

At the outset, the learned counsel for the respondent-State has referred to the counter affidavit filed on behalf of the respondents no. 2 & 6 on 10.01.2018, more particularly to paragraphs no. 6 & 7 thereof, wherein it has been stated that the public way has been opened and now there is no encroachment as also the Rasta in question is free from any encroachment, hence no

Accordingly, the present writ petition stands disposed off as having been rendered infructuous.
