The petitioner is seeking regular bail in Rupauli P.S. Case No. 211 of 2017 registered under Section 392 of the Indian Penal Code.

It is submitted that the petitioner is not named in the F.I.R. and he has no criminal antecedent. The police is said to have recovered one motorcycle and a mobile phone from possession of the petitioner on the basis of the confessional statement of the co-accused. Learned counsel for the petitioner submits that it would be evident from Annexure '2' to the present application that the motorcycle, which has been seized by the police, was purchased by the father of the petitioner from Jai Shakti Motors and he is in possession of the invoice and other

Patna High Court Cr.Misc. No.203 of 2018 (2) dt.12-01-2018 2/2 documents to support the said purchase, still the police has falsely implicated him alleging that the motorcycle is a stolen property. Considering the facts and circumstances of the case, let the petitioner, named above, be released on bail on his furnishing bail bond of Rs. 15,000/- (Fifteen thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate I, Purnea in connection with Rupauli P.S. Case No. 211 of 2017, subject to the conditions as laid down under Section 437(3) Cr.P.C.
