The petitioner seeks bail in connection with Kharik P. S. Case No.136 of 2021, instituted for the offences under Sections 30(a), 38(i) of the Bihar Prohibition and Excise Act. The learned counsel for the petitioner submits that the petitioner is in custody since 01.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case.

Allegation is of recovery 10720 litre of spirit along with ten bags of compose from a truck and the petitioner is alleged to be cleaner of the truck.

The learned counsel for the petitioner submits that

Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody since 01.07.2021, he is a person with clean antecedent and charge-sheet has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Bhagalpur in connection with Kharik P. S. Case No.136 of 2021.

The application stands allowed.
