JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 01-02-2016 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Islampur PS Case No.223 of 2015 disclosing offences under Sections 406, 417, 420 and 120(B) of the Indian Penal Code.

It is stated that the informant's father had purchased a tractor which was handed over to Sharwan Kumar by the informant's father for the purpose of some business. The tractor is said to be missing. Allegation is that co-accused Sharwan Kumar told the informant that he had handed over the tractor to the petitioner on the assurance that the petitioner would be giving him money. Learned counsel for the petitioner submits that except the allegation that the said Sharwan Kumar, driver of the tractor, disclosed the name of the petitioner, there is nothing against him. He further submits that the said Sharwan Kumar and another co-accused Munna Yadav have been granted regular bail by this Court, vide order dated

Patna High Court Cr.Misc. No.58202 of 2015 (2) dt.01-02-2016 2/2 10.11.2015, passed in Cr. Misc. Nos. 50617 of 2015 and 51113 of 2015 Considering the submission that other coaccused persons have been granted regular bail, this application for anticipatory bail is allowed. It is directed that in the event of his arrest, the petitioner above-named, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Hilsa at Nalanda, in connection with Islampur PS Case No. 223 of 2015 (GR No.1669/2015), subject to the conditions as laid down under Section 438(2) CrPC. This is subject to the further condition that the petitioner shall present himself before the police/Court below, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
