The petitioner seeks anticipatory bail in connection with Jagdishpur P.S. Case No. 117 of 2017 registered for offences punishable under Sections 341, 447, 323, 325, 307, 379 and 34 of the Indian Penal Code.
As per F.I.R., allegation against the petitioner is that the petitioner along with other accused persons is of assaulting the informant with danda and snatching his mobile, causing injury.
Submission of the learned counsel for the petitioner is that the petitioner is not named in the F.I.R. and there is no any specific allegations against the accused persons and both the parties are cousin brothers and the name of the petitioner transpired on the basis of supervision made by the Deputy
Patna High Court Cr.Misc. No.74484 of 2018(3) dt.29-01-2019 2/2 Superintendent of Police due to ulterior motive and he has no criminal antecedent.
Learned A.P.P. opposes the prayer for bail.
Having heard both sides and in view of the facts and circumstances, as discussed above, let the petitioner, above named, in the event of his arrest or surrender, be released on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each in connection with Jagdishpur P.S.Case No. 117 of 2017 to the satisfaction of Chief Judicial Magistrate, Bhagalpur, subject to the conditions as laid down under Section 438 (2) of Cr.P.C. with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court.
