====================================================== CORAM: HONOURABLE MR. JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 30-09-2019 Heard Learned counsel for the petitioners and learned APP for the State.
The petitioners in the present case are seeking anticipatory bail in connection with Punpun P.S. Case No. 67 of 2019 registered for the offences punishable under Sections 147, 149, 307, 506 of the Indian Penal Code.
The allegations against these petitioners are that they had been among 20-25 persons who had caused hurt to the informant, his brother and one Baby Devi by fists, legs and lathi for the illicit relationship of the informant with the sister of the petitioner no. 1.
Learned counsel for the petitioners submits that there
Patna High Court CR. MISC. No.42497 of 2019(3) dt.30-09-2019 2/3 is no specific allegation against these petitioners and the injury report available on the record as Annexure '2' would show that they are simple injuries.
In the given facts and circumstances of the case, since there are general and omnibus allegation against these petitioners and the injuries are simple in nature, given the kind of allegations, let the petitioners above named in the event of their arrest or surrender within a period of four weeks from today in connection with Punpun P.S. Case No. 67 of 2019 be released on bail on furnishing of bail bond of Rs. 15,000/- (fifteen thousand) with two sureties of the like amount each to the satisfaction of Sri Ranjay Kumar, J. M. Masaurhi, Patna, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. i.e.
(i) a condition that the person shall make himself available for interrogation by a police officer as and when required;
(ii) a condition that the person shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer;
