The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 379 and 411 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners are persons with clean antecedent, are son and father and are joint owner of tractor bearing Registration No. BR25G7710, it is next alleged that the tractor was apprehended by the police on the allegation of committing theft of sand. Learned counsel for the petitioners submits that though the petitioners were not involved in the occurrence nor

Patna High Court CR. MISC. No.53689 of 2021(2) dt.08-08-2022 2/2 were present at the place of occurrence but still they have deposited the fine of Rs. 63,520/- in the District Mining Officer, Jehanabad.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Shakurabad P.S. Case No. 94 of 2021 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) shivam/- U T
