JUSTICE SUDHIR SINGH ORAL ORDER 02-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 420, 467 and 468 of the Indian Penal Code.

Allegation against the petitioner is that he along with others had withdrawn the money from the bank which was meant for wages to informant and others. As such, he cheated the informant and others.

It is submitted on behalf of the petitioner that he has got no criminal antecedent. He is said to be the Rojgar Sewak of the Panchayat. He has been made accused due to mistake of fact. The alleged occurrence is said to have taken place in the year 2011 and petitioner is said to have joined on 22.2.2012. At the relevant time petitioner was not holding the post of Rojgar Sewak at Chiraiya Block, Motihari.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the

Patna High Court Cr.Misc. No.56864 of 2015 (3) dt.02-03-2016 2/2 above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Dhaka, East Champaran, in connection with Chiraiya P.S. Case no. 27 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
