23-01-2019 Heard Sri Siddhartha Prasad, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 17-07-2018 in Khagaria P.S. Case No. 888 of 2017 registered for offence under Section 364 of the Indian Penal Code, has prayed for grant of bail.
Sri Prasad, learned counsel for the petitioner submits that the case is based on circumstantial evidence. He further submits that in this case, at least two accused persons were granted the privilege of anticipatory bail. He further submits that though informant had alleged the petitioner as only accused in the F.I.R., in his re-statement, he has changed the version and he stated that offence was committed by two accused persons. On aforesaid ground, a prayer has been made for granting bail.
Patna High Court Cr.Misc. No.71009 of 2018(3) dt.23-01-2019 2/2 In this case, earlier case diary was called for, which has been received. The case diary indicates that petitioner was lastly seen with the deceased and telephone detail has also been obtained and after investigation, accusation was found true. In view of facts and circumstances, I do not find any ground to pass favourable order.
The prayer for bail stands dismissed.
