JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 29-01-2016 Heard learned counsel for the petitioner and learned counsel for the State.
The petitioner seeks pre-arrest bail in connection with Khajauli P. S. Case No. 53 of 2015 registered under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. It has been contended by learned counsel for the petitioner that co-accused Ram Karan Safi, Dilip Sah @ Dilip Safi, Ramesh Safi @ Ramesh Kumar Safi, Urmila Devi and Jitani Devi, having more or less identical allegation to that of the petitioner, have already been granted anticipatory bail by a co-ordinate Bench of this Court vide a reasoned order dated 19.01.2016 passed in Cr. Misc. No. 57806 of 2015.

Learned counsel for the State concedes that the case of the petitioner stands on more or less identical to that of other co-accused persons who have already been granted anticipatory bail by a co-ordinate Bench of this Court.
Regard being had to the reasons assigned in the aforesaid order dated 19.01.2016 passed in Cr. Misc. No. 57806 of 2015, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vivek Vishal, learned Judicial Magistrate-1st Class, Madhubani in Khajauli P. S. Case No. 53 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure. (Ashwani Kumar Singh, J.) Kanchan/- U T
