The petitioner seeks bail in Neemchak Bathani P.S. Case No. 162 of 2018, registered for the offences punishable under Sections 379, 406, 420, 467 and 468 of the Indian Penal Code.
It is alleged that petitioner used to run a finance company and also give loan for purchase of vehicles. It is alleged that petitioner persuaded several persons including this informant to open account and deposit money in his bank in the name of providing loan for vehicle. Informant along with some other persons opened account and deposited money in his bank, but he did not finance any loan for the vehicle to a single person. Patna High Court CR. MISC. No.41085 of 2019(3) dt.20-09-2019 2/2 amount from the account of different account holders including the informant and also took A.T.M card, PAN card, Aadhar Card etc. of different persons.
It is submitted on behalf of the petitioner that petitioner has falsely been implicated in this case. The allegation of withdrawal of money from different account is false and baseless. Petitioner is in custody since 30.11.2018. Chargesheet has already been submitted and there is no chance of tampering with the evidence.
Considering the facts aforesaid, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000 (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate Xth, Gaya in connection with Neemchak Bathani P.S. Case No. 162 of 2018.
