The petitioners seek regular bail in connection with Baisi P.S. Case No. 210 of 2017 dated 3.11.2017 for the offences punishable under Sections 273 of the India Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 7.5 liters of licit liquor from auto-rickshaw of the petitioners. The petitioners were apprehended while they were fleeing away upon seeing the police.
The learned counsel for the petitioners submits that the petitioners are neither the owner nor the driver of the said
Patna High Court Cr.Misc. No.63626 of 2017 (2) dt.17-01-2018 2/2 rickshaw. It is further submitted that the petitioners have a clean antecedent and they are in custody since 4.11.2017. Considering the nature of accusation, the period of custody already undergone and the fact that the petitioners have a clean antecedent, the petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned 3rd Addl. Session Judge- cum- Special Judge (Excise), Purnea in connection with Baisi P.S. Case No. 210 of 2017. (Mohit Kumar Shah, J) BTiwary/- U T
