The petitioner apprehends his arrest in connection with Tandwa P.S. Case No. 59 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. Petitioner was not present at the time of alleged occurrence. The petitioner has given his motorcycle to his friend for taking medicine for his family member. He has no concern with the alleged recovery. Further he submits that it is evident from the first information report that the apprehended persons neither disclose the name of this petitioner nor give any reply about the recovered materials.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Aurangabad in connection with Tandwa P.S.
