This application for regular bail arises out of Kawakol P.S. Case No. 169 of 2019, disclosing the offence punishable under Sections 363 and 364 of the Indian Penal Code and later on Sections 302, 201 and 120(B) of the Indian Penal Code were added. Similar prayers of the petitioner were earlier rejected by this Court.

A report has been received from the trial court as regards stage of the trial arising out the Kawakol P.S. Case No. 169 of 2019 in compliance of this Court's order dated 31.08.2022 passed in this case, from which it appears that the case is running at the stage of prosecution's evidence. Learned counsel for the petitioner states that six

Be that as it may, considering the situation that the trial is at advanced stage, I am not inclined to reconsider the petitioner's prayer for his release on bail.

This application is accordingly rejected.

It is, however, observed that the trial court shall take all possible steps to ensure early conclusion of the trial. It is further observed that if the trial is not concluded within six months, the petitioner shall be at liberty to renew his prayer for bail.
