This is a petition for grant of anticipatory bail for offence under Sections 147, 148, 149, 323, 341, 307, 342, 325, 323, 353 and 452 of the Indian Penal Code and 27 of the Arms Act.
The petitioner was former Secretary of the Association. Allegation is that the petitioner was leading a mob of associates and was instigating the mob to attack on the informant, who was the Chief Engineer of the North Bihar Power Distribution Company. Further, allegation is that the petitioner and others, with intent to commit murder, attacked on the informant and caused injury on the fore-head. Submission of the petitioner is that the allegation general and omni bus.
The doctor has found simple injury, caused by hard and blunt substance on the injured.
The learned counsel for the State opposed the prayer for bail.
Considering the aforesaid fact, the petitioner, above
Patna High Court Cr.Misc. No.1914 of 2017 (3) dt.10-02-2017 2/2 named, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Kotwali P.S. Case No. 553 of 2013 to the satisfaction of the Chief Judicial Magistrate, Patna, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
