In this case, the petitioner is seeking anticipatory bail in connection with Sugauli P.S. Case No. 103 of 2019 registered for offence punishable under sections 272, 273/34 of the Indian Penal Code and section 30(a) of the Bihar Prohibition and Excise Act.

The police raided the village and recovered from the cane field 30 litres of country made liquor and it has been alleged that all the three petitioners entered into the business of illegal liquor and thereafter, the police party moved towards village Mehana from where 15 litres liquor kept in tube, 7 litres liquor kept in a gallon of 10 litres and 200 litres half made

Patna High Court CR. MISC. No.43269 of 2019(2) dt.12-07-2019 2/2 country made liquor was recovered. The name of this petitioner has surfaced during investigation. The petitioner no. 2 has criminal history.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioners and accordingly their prayer for bail is rejected. However, if the petitioners surrender and prays for regular bail, the court below will take decision in accordance with law.
