The petitioner seeks bail in a case instituted for the offences under Section 304(B) and 201/34 of the Indian Penal Code.
The earlier bail applications of the petitioner were rejected vide Annexure-1 series to the present application taking into account that the onus was on the petitioner (husband) to explain the cause of death of the deceased. This is third application filed for grant of regular bail to the petitioner. A report was called for from the Trial Court regarding the state of the case. It has been reported that the trial is expected to be concluded within a period of three months. On behalf of the State, it is submitted that the

Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to conclude the trial within a period of four months preferably on day to day basis from the date of receipt/production of a copy of this order.
The District Magistrate, Sheikhpura and the Superintendent of Police, Sheikhpura are also directed to take necessary steps to produce the remaining witnesses on the date fixed in the Trial Court so that the trial could be concluded within the stipulated period.
