2. The petitioner seeks bail in connection with the present case registered for the offence punishable under Sections 30(a), 32(i)(ii) and 41(i)(ii) of the Bihar Prohibition and Excise Amendment Act, 2022.
3. There is recovery of 240.12 litres of illicit liquor. The petitioner is in jail since 12.06.2024 and has clean antecedent.
4. Learned counsel for the petitioner submits that the petitioner is ready to donate Rs. 25,000/- (Rupees Twenty Five Thousand Only) in some charitable organization without accepting his guilt.
5. Considering the facts and circumstances of the case
Patna High Court CR. MISC. No.47064 of 2024(2) dt.10-07-2024 2/2 and the submission of learned counsel for the petitioner, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge (Excise)-II, Kaimur at Bhabhua/concerned court below in connection with Prohibition and Excise (Kaimur) P.S. Case No. 514 of 2024 subject to the condition that:- The petitioner shall deposit an amount of Rs. 25,000/- (Rupees Twenty Five Thousand Only) in Ramakrishna Mission Home of Service, Varanasi, Luxa, Varanasi, Uttar Pradesh 221020 and produce the receipt of the same before the Court below.
The bail bonds of the petitioner shall be accepted after verifying the genuineness of the receipt produced by the petitioner.
