Bhupendra Kumar @ Bholi who happens to be an accused in connection with Turkaulia P.S. Case No.149/2017 was apprehended and on interrogation, he confessed his guilt to be assailant of Jhabbulal Bhagat by means of firearm and further disclosed that he is still possessing one countrymade pistol having concealed in a maize field whereupon police party proceeded to the location and as pointed out by the aforesaid Bhupendra Kumar @ Bholi, same was recovered. From the order impugned, it is evident that though, self statement is completely lacking but aforesaid accused Bhupendra Kumar @ Bholi had shown the petitioner Tuntun Kumar @ Tun Tun Bhagat @ Gapu who after handing over two countrymade pistol paid Rs.5000/- in order to commit murder of Jhabbulal Bhagat and further assured that, after commission of the offence rupees twenty thousand will be paid. Charge sheet had already been submitted on the basis of the aforesaid

That being so, petitioner Tuntun Kumar @ Tun Tun Bhagat @ Gapu is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Motihari, East Champaran in connection with Turkaulia P.S.
