Petitioner apprehends his arrest in K. Nagar P.S. Case No.204 of 2018 registered under Sections 363 and 365 of the Indian Penal Code.
The informant, the husband of the victim, alleged that he did not find his wife in his house and on enquiry the informant came to know that Ajay Yadav and Heeralal Yadav with the help of Sachin Yadav, Anarwa Devi, Santosh Yadav, Vidyanand Yadav and Annu Kumar Yadav took her wife and kept her concealed.
Learned counsel for the petitioner submits that the victim made her statement under Section 164 Cr.P.C. She disclosed that she lived with the petitioner and did not raise any
Patna High Court Cr.Misc. No.74919 of 2018(3) dt.10-01-2019 2/2 alarm. The victim is major.
Considering the facts aforesaid and nature of allegation made against the petitioner and the fact that the victim is a major woman and she appears to be living voluntarily with the petitioner, let petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt of this order be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with K. Nagar P.S. Case No.204 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
