The petitioner is in custody in connection with Bachhawara P.S. Case No. 14 of 2017 registered for the offence punishable under Sections-363, 379, in which, later on, Sections365/368/370(iv), 34 of the Indian Penal Code was also added.

The FIR of the kidnapping of son of the informant is against unknown. During investigation, the name of this petitioner surfaced in the confessional statement of co-accused to this effect that the petitioner had removed the child and delivered to the petitioner who kept him as son because, the petitioner had no son.

Counsel for the informant opposed the prayer for the purpose of bail.

From perusal of the FIR, no offence is made out against the

Patna High Court Cr.Misc. No.63553 of 2017 (3) dt.12-03-2018 petitioner.

Considering the aforesaid facts, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 20,000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court below in connection with the aforesaid case.
