The petitioner, already in custody, seeks bail in connection with Dhanarua P.S.Case No. 265 of 2015 registered under Sections 304B and 201/34 of the Indian penal Code. Allegation in brief is that marriage of the informant's grand daughter was solemnized with petitioner on 30.04.2015 and just after three months, due to non-fulfillment of further demand of dowry, she was killed by accused persons.
Learned counsel for the petitioner submits that petitioner is a very poor person and deceased died due to accidental burn injury while preparing meal and petitioner is in custody since 12.04.2017.
Learned counsel appearing on behalf of the State
Patna High Court Cr.Misc. No.61114 of 2017 (2) dt.19-12-2017 2/2 submits that the petitioner is husband and within three months of the marriage, deceased was done to death as demand of further dowry was not fulfilled and after killing the dead body was also disposed of.
Having considered the aforesaid facts and circumstances and the fact that petitioner is husband having specific allegation against him, prayer for bail is rejected. However, trial court is directed to expedite the trial and preferably to conclude the same within a year from the date of framing of charge.
Let a copy of the order be sent to the Senior Superintendent of Police, Patna to ensure production of prosecution witnesses before the trial court for expeditious disposal of the trial.
