The petitioner apprehends his arrest in connection with Amarpur P.S. Case no. 399 of 2016, registered under Section 457 of the Indian Penal Code.
The accusation is that in the night of 19/20.09.2016, Fulo Devi, daughter-in-law of the informant raised alarm about thief, then informant, who was sleeping at his Bathan, reached there and saw the petitioner fleeing away, but he could not apprehend the petitioner. Thereafter, on checking of the house, no any material was found stolen.
Learned counsel for the petitioner submits that petitioner and the informant are co-villagers and due to earlier dispute and misunderstanding the petitioner has been implicated in this case. The
Patna High Court Cr.Misc. No.2401 of 2017 (2) dt.15-02-2017 2/2 petitioner has no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 399 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
