The petitioners seek regular bail in Belaganj P.S. Case No. 250 of 2017 registered for the offence under Sections 341, 323, 353 and 34 of the I.P.C.

Allegation against the petitioners is of creating hindrance in removing encroachment from the public land by the Government officials and making protest.

Submission of the learned counsel for the petitioners is that there is no specific allegation attributed to the petitioners and there is also no allegation of assault against them and they are in custody for three months having no criminal antecedent. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

No.62470 of 2017 (2) dt.11-01-2018 2/2 circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bonds of Rs.25,000/- each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-11, Gaya in Belaganj P.S. Case No. 250 of 2017, subject to the conditions that (1) one of the bailors must be local person having sufficient immovable property within the jurisdiction of the concerned court. (2) The petitioners will not induce any witness or tamper with the evidence. (3) The petitioners shall co-operate in the disposal of trial and make themselves available as and when required by the court and in the event of failure to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution is free to move for cancellation of their bail bonds.
