2. The petitioner, in the present case, is seeking prearrest bail in connection with Khagaria (Gangour) P.S. Case No. 227 of 2021, G.R. No. 886/2021 registered for the offences punishable under Sections 341, 323, 308, 504 & 506 of the Indian Penal Code. He has no criminal antecedent as stated in paragraph '3' of the application.
3. As per the prosecution story, the informant has alleged that while he was doing work with other labourer at the same time the accused came there and tried to stop the work and assaulted him with iron rod with an intention to kill.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case. Learned
Patna High Court CR. MISC. No.46886 of 2023(2) dt.30-08-2023 2/3 counsel submits that the informant and petitioner are said to be the full brothers and the alleged occurrence took place on account of a land dispute over construction of the house.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

Having regard to the facts and circumstances of the case wherein the informant and the petitioner are said to be the full brothers and the alleged occurrence took place on account of a land dispute over construction of the house, in the said occurrence a simple injury has been caused to the informant by hard and blunt substance, petitioner has otherwise no criminal antecedent, hence, this Court directs that in case of his arrest/surrender within a period of four weeks from today, let the petitioner above-named be enlarged on bail on furnishing of bail bond of Rs. 25,000/- (twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Khagaria, in connection with Khagaria (Gangour) P.S. Case No. 227 of 2021, G.R. No. 886/2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
7. And further condition that the court below shall verify the criminal antecedent of the petitioner and in case at

No.46886 of 2023(2) dt.30-08-2023 3/3 any stage it is found that the petitioner has concealed his criminal antecedent, the court below shall take step for cancellation of bail bond of the petitioner. However, the acceptance of bail bonds in terms of the above-mentioned order shall not be delayed for purpose of or in the name of verification.
