The petitioner is apprehending his arrest in connection with Laukaha P.S.Case No.62 of 2018 G.R. No.293 of 2018 registered for offences punishable under Sections 341, 323, 498A, 379, 504, 494 of the Indian Penal Code and Section 3⁄4 of the D.P.Act.

Allegation against the petitioner is of demand of one colour T.V., one motorcycle and other articles and for that assaulting the complainant and ousting her from the house. Submission of the learned counsel for the petitioner is that he is ready to keep her and allegations are false and concocted, whereas the learned counsel for the O.P.no.2 has

Patna High Court CR. MISC. No.42872 of 2019(4) dt.26-09-2019 2/2 submitted that the petitioner has solemnized second marriage and apart from that he has already been granted benefit of Section 41A of the Cr.P.C., as such he should surrender and pray for regular bail.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on the basis of the materials available on the record as well as the fact that he was on police bail earlier and considering the same the learned court below shall try to dispose of the application for bail, if possible on the same day.

With the aforesaid direction, this application is disposed of.
