JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-06-2021 Heard Mr. Arun Kumar, learned counsel for the petitioner and Mr. A.M.P. Mehta, learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Kudhani ( Turki O.P.) P.S. Case No. 424 of 2019 instituted for the offences under Section 399, 402 and 34 of the Indian Penal Code and Sections 25(1-b) (a), 26/35 of the Arms Act.

It has been submitted on behalf of the petitioner that the police arrested one Suraj Kumar Yadav and he is stated to have disclosed the names of his associates including the petitioner.

Learned counsel for the petitioner has submitted

Patna High Court CR. MISC. No.40183 of 2020(2) dt.15-06-2021 2/2 that he is not at all associated with aforesaid Suraj Kumar Yadav and his implication in the present case is only on the basis of confession of an arrested accused person. The petitioner does not have criminal antecedents and nothing incriminating also could be traced to him Considering the aforesaid facts, the petitioner, above named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt / production of a copy of this order, on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -III, Muzaffarpur, in connection with Kudhani ( Turki O.P.) P.S. Case No. 424 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
