The petitioners seek bail in Gaighat P.S. Case No. 225 of 2021, registered for the offence punishable punishable under Sections 272, 273/34 of the Indian Penal Code and sections 30(a), 36 and 41(1) of the Bihar Prohibition and Excise Act, 2018.

2643.840 litres of foreign liquor has been recovered from a vehicle and these petitioners were apprehended by the police while fleeing away from the place of recovery. It is submitted that no incriminating article has been recovered from conscious possession of petitioners. Petitioners

Patna High Court CR. MISC. No.53707 of 2021(2) dt.03-12-2021 2/2 are neither driver nor owner of vehicle in question and they have got no concern with the seized liquor. Petitioners are in custody since 01.07.2021 having no criminal antecedent, as stated in para 3 of the petition. Investigation is complete. Considering the period of custody coupled with the fact that petitioners bear clean antecedent, the petitioners above-named, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Muzaffarpur in connection with Gaighat P.S. Case No. 225 of 2021.
