1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 363 and 366(A) of the Indian Penal Code.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the informant being brother of Azim who was in love with the victim and the victim had eloped with his brother.

4. It is further submitted that the case was taken up on 29.08.2025 when a submission was made by the learned APP that the victim has been recovered, as informed by the SSP, Darbhanga.

5. The learned APP for the State submits that a supplementary counter affidavit is going to be filed. It is also submitted that the statement of the victim was recorded under Section 183 BNSS wherein she has not supported the case of the prosecution.

6. After hearing the learned counsel for the parties, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Jalley P.S. Case No. 178 of 2018 subject to the conditions as laid down under Section 482 (2) of BNSS.

7. Accordingly, the instant anticipatory bail application stands allowed.
