JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-05-2019 The present application has been filed by the petitioner for a direction to the respondents to remove encroachment over plot no. 1075 and Khata No. 143 being the public land after measurement.

Learned counsel for the petitioner submits that respondents have issued notice for measurement way back in 8.5.2012 but after notice they have not taken steps for measurement and for removal of encroachment over public pathway.

Considering the aforesaid, the writ petition is disposed

Patna High Court CWJC No.6091 of 2014(3) dt.06-05-2019 2/2 of with direction to the respondent no.4, the Circle Officer, Siwan to take steps for measurement of the land in presence of the parties and thereafter decide whether there exist any encroachment over the public land or not and after hearing the parties including the encroachers, the Circle Officer, Hussainganj, Siwan shall pass appropriate order for removal of encroachment within a maximum period of six months from the date of receipt/production of a copy of this order. With the aforesaid, the writ application stands disposed of.
