JUSTICE ARVIND SRIVASTAVA ORAL ORDER 16-02-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.
The petitioners apprehend their arrest in connection with Khaira P.S. Case No. 150 of 2016 registered under Sections 147, 148, 149, 323, 332, 333, 337, 338, 307, 353 and 153(A) of the Indian Penal Code.
The accusation is that accused persons, including the petitioners and 50-60 unknown persons armed with weapons and bricks were abusing each other by their caste name. When the police tried to pacify the matter, they threw bricks, in which the Police Party sustained injuries.
Learned counsel appearing on behalf of the
Patna High Court Cr.Misc. No.1866 of 2017 (3) dt.16-02-2017 2/2 petitioners submits that the petitioners have falsely been implicated in this case with general and omnibus allegations. There is no specific allegation against the petitioners. Further submission is that similarly situated co-accused persons have already been allowed bail by a Bench of this Court vide Cr. Misc. No. 337 of 2017.
Having considered the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M.-X, Saran, Chapra in connection with Khaira P.S. Case No. 150 of 2016, subject to the condition as laid down under Section 438(2) of the Cr. P.C. (Arvind Srivastava, J) Shail/- U T
