The petitioner apprehends arrest in a case registered for the offence punishable under sections 307/34 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per FIR, firing made by this petitioner did not cause any injury. It was co-accused Ashok Yadav who caused fire arms injury in the stomach of son of informant. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State as well as the

Patna High Court CR. MISC. No.44436 of 2022(2) dt.05-12-2022 2/2 informant oppose the prayer for bail. They submit that the petitioner is named in the FIR with allegation that he too made firing.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Begusarai in Birpur Police Station Case No. 72 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
