1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 316(2), 316(5) and 318(4) of the Bharatiya Nyaya Sanhita.

3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a woman. It is next submitted that the license of PACS, Nauhatta West, was cancelled by the Sub-divisional Officer vide his order dated 1-92022 on account of irregularities committed, as such, the PDS shop was being run by the Executive PACS President, Mrs. Kaushar Praveen and Manager Arbind Thakur, further 79.23 quintal of wheat and 120.26 quintal of rice was left on E-POS machine and the same was to be handed over to Virendra

Patna High Court CR. MISC. No.42728 of 2025(5) dt.29-08-2025 2/3 Chaudhary, but the same was not done, on account of which the beneficiaries were facing difficulties.

4. Learned counsel for the petitioner submits that husband of the petitioner was the President of the PACS, but after his death, the petitioner became the Executive President of the PACS. It is further submitted that it is not a case of defalcation or siphoning of food-grains. It is also submitted that the entire grain has been handed over to Virendra Chaudhary and Arvind Thakur, Manager of the PACS, was granted the privilege of anticipatory bail by an order dated 09.07.2025 in Criminal Miscellaneous No. 42149 of 2025.

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nauhatta P.S. Case No. 250 of 2024, subject to the conditions as laid down

7. Accordingly, the instant anticipatory bail application stands allowed.
